Terms and conditions

This agreement sets out the terms and conditions of your subscription and is made between the subscriber and Shelter, registered office 88 Old Street London EC1V 9HU, registered company number 1038133.

Shelter reserves the right to alter these terms and conditions. Shelter should notify the subscriber of any change to these terms and conditions as soon as is reasonably practicable.

Please ensure that you print and retain a copy of these terms and conditions for your records.

1. Service

A subscription to Shelter Legal entitles the subscriber to a non-transferable 12-month subscription to the online housing law information system known as Shelter Legal, beginning from the day that the subscriber's login details are sent to her/him by email or by post.

Sent does not imply any receipt by the subscriber.

Shelter is not responsible for the non-receipt of emails or letters by the subscriber.

Payment is by invoice, cheque, or credit/debit card. Failure to pay the subscription in full will constitute a material breach of the agreement and will result in the service being withdrawn.

The subscription is limited to the number of users paid for by the subscriber and entitles such users to use Shelter Legal only in accordance with the terms and conditions set out in this agreement.

For each subscriber there will be a number of users attached to the subscription. User licences can only be allocated to people working for the same organisation, team or department.

It is the responsibility of the subscriber to ensure that all users act in accordance with this agreement.

Each user has a unique login and password. The user creates these when they first use Shelter Legal. Shelter will store this information for the purposes of support and in accordance with the Data Protection Act.

Subscribers and users can print individual pages for their own use only.

Shelter Legal is an internet-based service. Shelter cannot guarantee that this service will be available on a 24-hour basis. Shelter reserve the right to take the system off-line for any reason that it deems necessary.

2. Additional users/removal of users

Subscribers may request that additional users are included in their subscription but only up to the maximum number of users paid for. If the request for an additional user exceeds the maximum number of users paid for, the user cannot be added unless the subscriber upgrades their subscription to the next user band.

User bands are:

1-5 users
6-20 users
21-50 users
51-100 users
101 or more users.

Shelter will endeavour to make Shelter Legal available to additional users within one working day, subject to receipt of any additional payment.

The subscriber is responsible for adding and removing users from their subscription.

3. Subscription renewal

Subscribers should receive a reminder and pro-forma invoice two months before the expiry of the subscription period. Additional reminders may be issued at Shelter's discretion. Subscribers will be told the date on which a subscription will expire and if payment has not been received by this date, access to Shelter Legal will be withdrawn.

4. Support

Shelter offers subscribers telephone and email support in relation to problems with logging on to the system and queries about subscriptions.

Support can be accessed between the hours of 9.30am and 4.00pm Monday to Friday only (excluding public holidays).

Shelter cannot provide support to subscribers outside these hours.

A subscription to Shelter Legal does not entitle the subscriber to support, advice or information in relation to an individual client, whether by letter, email, telephone or any other method.

5. Updates

Subscribers and users can choose to receive notification of updates by email. Subscribers and users can unsubscribe from the email notification and any other email communication sent to Shelter Legal subscribers.

6. Termination of agreement

The subscription period is 12 months. During the subscription period, the agreement can only be terminated if either party commits a material breach of the agreement and this breach can be remedied but is not remedied within 30 days of the affected party notifying the other in writing of the breach. This agreement is governed by the provisions of UK law and the individual jurisdictions therein.

7. Disclaimer

The information contained on Shelter Legal gives only general guidance on the law as it relates to England and Wales. It offers an interpretation of the current law in the particular jurisdiction of the subscriber. Subscribers and users accept that there may be alternative interpretations of the law and therefore Shelter Legal should not be regarded or relied upon as a complete or authoritative statement of the law.

Shelter does not represent or warrant that the information accessible via the website is accurate, complete or up to date. Price and availability of information is subject to change without notice.

Shelter will not be liable (to the fullest extent permitted at law) for any loss, damage or inconvenience arising as a consequence of any use of or the inability to use any information on Shelter Legal.

The performance of Shelter Legal may vary with the type of systems and software employed by the subscriber. Shelter cannot verify that all systems and software will be compatible with Shelter Legal.

Shelter takes no responsibility for the contents of linked websites and links should not be taken as endorsement of any kind. Shelter has no control over the availability of the linked pages.

8. Data protection

For each subscriber there will be a number of users attached to the subscription. See the list of user bands above. Such users may be asked to submit personal information in order to receive materials or use services on the Shelter website. Shelter will not send subscribers or users information on other Shelter products, services and activities unless the subscriber has expressly opted to receive these.

Shelter will treat subscribers and users personal data in strict compliance with the Data Protection Act. If Shelter wishes to collect and use data in any other way, subscribers' express permission will be sought at the point of collection.

Shelter Legal uses cookies to remember a user's selected homepage. Cookies are not used to collect information on users other than that required for gathering anonymous statistics and system administration of the Web server.

9. Copyright

Shelter Legal is available only for subscribers' non-commercial use.

Subscribers and users may not copy, reproduce, republish, post, distribute, transmit or modify in any way all or any part of this site or the information contained therein.
