An outline of the legal framework for community care provisions, and knowledge of local authority duties, powers and responsibilities in the assessment and provision of community care needs in a housing context.
Course contains
- Powers and duties of local authorities under the NHS and Community Care Act 1990 and allied legislation
- Effects of recent case law on powers and duties, especially in the housing field
- Powers to charge for services
- Challenges to assessments and to the provision of services
- Current unresolved issues in community care
- Relationship between community care and other housing legislation
Learning outcomes
After this course, you will be able to:
- Understand how eligibility criteria operate
- Identify services that should be provided as a right
- Understand the ‘personalisation’ agenda
- Take account of the uncertainties about the framework for future service delivery.
Suitable for
Advisers who give housing advice and support to vulnerable people, especially those who are elderly, have mental health issues, learning disabilities, or are physically disabled. A basic working knowledge of homelessness legislation is useful but not essential.
