Course objectives

This course provides an understanding of how mortgages work and the options available to borrowers who, for whatever reason, are unable to meet their payments. Delegates will gain the skills, information, and confidence to:

  • negotiate favourable settlements with lenders
  • give useful advice to those facing possession proceedings
  • deal with intentional homelessness issues
  • advise tenants as to their rights when their landlord defaults on the mortgage.

  • Characteristics of mortgages
  • Making mortgages manageable
  • Support for Mortgage Interest 
  • Negotiating with lenders in light of the Mortgage Conduct of Business (MCOB) rules and the Pre-action Protocol
  • Possession proceedings
  • A brief overview of the Consumer Credit Acts 1974 & 2006 and how these Acts help borrowers with second loans secured on their properties 
  • Powers of the courts to prevent repossession and orders that district judges can make
  • Right of tenants living in mortgaged properties when their landlord defaults on the mortgage
  • Case law on intentionality relating to owner-occupied properties.

Learning outcomes

After this course, you will be able to:

  • Understand possible options for preventing the loss of the borrower’s home
  • Recognise when the law can assist a borrower in difficulties
  • Give advice on other matters connected with difficulties in paying a mortgage
  • Assess whether borrowers who lose their homes are intentionally homeless or not

Suitable for

Housing advisers who are required to offer mortgage advice, but who are presently finding this difficult and wish to resolve borrowers' problems more quickly. Less suitable for those with extensive experience.
