Homelessness Law and Domestic Violence

This course allows delegates to gain a basic understanding of homelessness law and domestic violence. In particular delegates will develop an understanding of when a local authority (Homeless Persons Unit and/or Social Services) has a duty to house a victim of domestic violence under the law. The course includes an up to date consideration of the new Homelessness Code of Guidance, as well as current Government thinking on the role of the local authority in dealing with domestic violence. 

Course contains

  • Current definition of domestic violence for local authorities
  • When a victim of domestic violence is considered homeless under the Housing Act 1996 and the Homelessness Act 2002
  • When a victim of domestic violence is considered eligible for assistance under the Housing Act 1996 and the Homelessness Act 2002
  • Duties of Social Services in relation to victims of domestic violence
  • Range of legal remedies available for victims of domestic violence
  • Knowledge of the Best Value Performance Indicator (BV 225) which includes recommendations for local authorities in relation to combating domestic violence
  • New code of Guidance for Local Authorities (July 2006) concerning the duties, power and obligations of local authorities in relation to victims of domestic violence
  • Domestic Violence Crime and Victims Act 2004 and how this new law might assist victims of domestic violence.

Suitable for

Local authority employees working in housing, the HPU or Social Services who wish to gain a better understanding of their duties towards victims of domestic violence. Anyone from other sectors who wishes to understand the role of the local authority in cases of domestic violence.
