Courses of action

Dealing with noise by using the Environmental Protection Act 1990 or taking action using the tort of nuisance.

There are two general courses of action for an occupier who is affected by noise, whether it is caused by another occupier or is related to the occupier's property. The first is to use the Environmental Protection Act 1990. This usually means action by the local council, but in some situations, it may be more appropriate for action to be taken by the occupier her/himself. The second course is for the occupier to take action using the tort of nuisance.
