The law on assignment of tenancies.

Where a joint or sole tenant wishes to pass on her/his tenancy to someone else, it is important that s/he follows the correct legal procedure, as if s/he does not, then the tenancy may be lost. There are several ways in which a tenancy can be transferred to another person, but not all of these methods will be available in every case. The position may depend upon:

  • the type of tenancy
  • what the tenancy agreement says
  • the reason for the transfer
  • whether the landlord agrees.

The main methods of transferring a tenancy are assignment and court transfer (under family law).
