Rules for different tenancy types

The rules for assignment for different types of tenancy.

The general right to assign, which can be limited or prohibited by the tenancy agreement, is also subject to statutory limits or prohibitions laid down by the Rent and Housing Acts. This affects the following types of tenancy:

  • secure and introductory tenancies
  • protected and statutory tenancies
  • protected shorthold tenancies
  • assured and assured shorthold tenancies.

All other types of tenancy can be assigned subject to the tenancy agreement and any consent required by the agreement as described on the page on Prohibition or consent.
