Assignment: Demoted tenancies

This content applies to England

Assignment of demoted tenancies.

Whether a demoted tenant has the right to assign their tenancy depends on whether they have a local authority demoted tenancy or a registered social landlord demoted tenancy.

Local authority demoted tenancies

A local authority demoted tenancy cannot be assigned, except as part of proceedings under family law.[1]

Registered social landlord (RSL) demoted tenancies

The rules for assignment for RSL demoted tenancies are the same as for periodic assured and assured shorthold tenancies, that is, generally only with the landlord's consent.
