Pitch fee reviews

This content applies to England

The control of mobile home rents and pitch fees.

There is no statutory provision for the control of mobile home rents or pitch fees, save for Regulations that prescribe the form of the document that must accompany a pitch fee review notice.[1] Most written agreements contain an annual review of pitch fees on stated grounds.

One case established that the court has a wide discretion in pitch fee disputes and that comparables with pitch fees on other sites are not important.[2] Pitch fee disputes can prove intractable and their resolution usually requires either agreement of the parties or an application to the court.

See the page on Implied terms for more about site owners' obligations when reviewing pitch fees and related prescribed forms and notices.
