This month's legal round up includes the government announcement of planned Consumer Credit Act reforms.
Consumer Credit Act reform
HM Treasury has announced that it plans to ‘modernise’ the Consumer Credit Act 1974 (CCA). The changes will have significant implications for debt advisers.
The majority of remaining CCA provisions will be repealed from legislation and potentially recreated in FCA rules. These include:
information requirements - pre-contract disclosures, post-contract statements, arrears notices, default notices
sanctions for non-compliance – unenforceability without a court order or until a breach is remedied, and not being able to add interest and charges for technical errors
voluntary termination of hire purchase and conditional sale agreements
There are some key provisions that will remain but could be subject to change following further consultation. These include:
time orders
pawnbroking
unfair relationships
The reforms will be legislated via the Financial Services and Markets Bill announced in the King’s Speech on 13 May 2026.
